General conditions of sale

1. ACCOUNT

We reserve the right to refuse access, close an account, if you are in violation of applicable laws, these terms of use or any other terms, conditions, guidelines or policies.

2. ORDER

For the first order, the user must create an online account with their personal details and keep them up to date. The contract is considered concluded after CIRCLE validates your order, following electronic receipt of the order form and verification of the order details. Before purchasing products by submitting the order form, you are asked to carefully read these General Terms and Conditions of Sale.

CIRCLE reserves the right to cancel and refund any order containing errors in price display (e.g., free orders) or item availability. By submitting the order form electronically, you unconditionally accept and agree to these General Terms and Conditions of Sale.

3. VALIDATION

The data recorded by our services when you validate your order constitutes proof of all transactions between CIRCLE and its customers. The data recorded by the payment system constitutes proof of financial transactions.

4. AVAILABILITY

Our store collects data to operate efficiently and provide you with the best possible experience with our services. You provide some of this data directly, for example, when you create a personal account. We obtain some of it by recording how you interact with our services using technologies such as cookies and by receiving error reports or usage data from software running on your device.

5. PRICE

The prices of our products are shown in euros, inclusive of all taxes, but excluding processing and shipping fees. These prices are provided in euros with the corresponding currency conversion. For orders shipped to countries other than mainland France, you are considered the importer of the product(s) in question. For all products shipped outside the European Union and French overseas departments and territories (DOM-TOM), the price will be automatically calculated excluding taxes on the invoice. Customs duties, local taxes, import duties, or state taxes may be levied. These duties and amounts are not the responsibility of circle-shop.fr. They are your responsibility and must be paid by you, both in terms of declaration and payment to the relevant authorities and organizations in your country. We advise you to inquire about these matters with your local authorities. All orders must be paid in either euros or US dollars.

6. DELIVERY

You have the option to choose:

- Standard home delivery by post (Delivery notice and parcel available for 15 days at your post office if you are absent)

- Delivery to a retailer or a Mondial Relay network locker

You will automatically receive an email with your tracking number (also available online by logging into your account). Products will be delivered to the shipping address you provided during the ordering process. We do our best to ensure delivery within 5 days. Should any issues arise, we will keep you informed.

If you have chosen the "In-store pickup" option, please come to the CIRCLE store, 3 rue Folco de Baroncelli, 84000 Avignon, with your order confirmation and your ID. You can pick up your products 24 hours after placing your order, up to a maximum of 10 days. Important: Any order placed on Saturday or Sunday with the in-store pickup option can only be collected on Monday after 4 PM. Shipping costs are calculated automatically when you finalize your shopping cart and are included in the total. When your package is shipped, we will send you the tracking number by email. Customs duties and other fees in the destination country are the responsibility of the buyer. In case of loss or damage to the product during transport, the customer must inform the carrier immediately.

In the event of a delivery delay exceeding 7 days that is not due to force majeure, the Customer is invited to contact customer service. They have the option to cancel their order and request a refund of the sums paid by registered letter with acknowledgment of receipt to the following address: Circle 3, Rue Folco de Baroncelli, 84000 Avignon, France. This right must be exercised no later than 30 business days following the expiry of the initially scheduled delivery date. The contract will be considered terminated upon receipt of the registered letter if the item has not been delivered between the sending and receipt of the letter. The Customer will then be refunded no later than 30 days from receipt.

7. PAYMENT

All orders shipped within France and the EU are priced in Euros, inclusive of all taxes, at the current French VAT rate. Additional information may be requested to secure your payment.

Payments are made as follows:

Either by bank card via the secure payment system
Either through the secure online payment system Paypal
Either in several installments with Scalapay

8. INTELLECTUAL PROPERTY

All texts, comments, works, illustrations, and images reproduced on the circle-shop.fr website are protected by copyright and intellectual property rights worldwide. As such, in accordance with the provisions of the French Intellectual Property Code, only use for private purposes is permitted, subject to any different or more restrictive provisions of the Intellectual Property Code. Any other use constitutes infringement and is punishable under Intellectual Property law unless prior authorization has been obtained from us.

9. APPLICABLE LAW - DISPUTES

This contract is written in French and governed by French law. In the event of any legal dispute, only the French courts shall have jurisdiction.

10. PERSONAL INFORMATION

The website www.circle-shop.fr is committed to not disclosing to third parties the information you provide. This information remains confidential. It will only be used by our internal departments to process your order, enhance and personalize communication, and tailor the cultural offerings reserved for our customers. Consequently, and in accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to the personal data concerning you. 11. RESPONSIBILITY

The products offered comply with current French legislation. It is your responsibility to check with the local authorities in your country regarding the import or use of the products or services you intend to order. The website www.circle-shop.fr cannot be held liable for failure to perform the contract in the event of stock shortage, product unavailability, force majeure, disruption, flood, fire, or strike, particularly affecting postal services, transportation, or communication.
